EPA's Pollution Exemption Struck Down By RITA CICERO, Andrews Publications Staff Writer
The D.C. Circuit has vacated an Environmental Protection Agency-approved regulation that allowed oil refineries, chemical plants and other industrial facilities to exceed emission standards for hazardous air pollutants when equipment malfunctions or the plants start up or shut down operations. The U.S. Court of Appeals for the District of Columbia Circuit ruled 2-1 that the exemption violated the plain text of the Clean Air Act.
